Terms and Conditions

If you have any questions about booking with us, please contact us before making a booking.

By placing a direct booking with us you (the lead guest) and your booking party (guests) agree to the following terms and conditions as set-out.

 

  1. Interpretation
    1. These terms and conditions shall be governed by and construed in accordance with the laws of Scotland.
    2. The suppliers are Duncan Astbury and Cherry Loughridge, operating as a self employed partnership with the trading name Four Oaks Bed and Breakfast, with STL licence AR00576, and with address:
            Four Oaks, Glencruitten, Oban, PA34 4QB, UK.
    3. The lead guest is the person who makes a reservation and to whom the invoice is addressed. The lead guest must be at least 18 years of age. In the case of joint guests (booking party) any liability for cost will be joint and several. All guests must be at least 15 years of age.
    4. Four Oaks Bed and Breakfast is not VAT registered and does not collect VAT.
    5. All bookings must conform to applicable laws, including but not limited to:
            The Civic Government (Scotland) Act 1982 (Licensing of Short-term Lets) Order 2022.
            The Visitor Levy (Scotland) Act 2024.
    6. Only these terms and conditions will apply.

  2. Payments and Cancellations
    1. Bookings will not be accepted for periods of more than 28 days.
    2. To secure a booking a deposit equal to the total cost of the booking is required, to be paid in advance.
    3. All payments must be denominated in GBP.
    4. Cheques and bank drafts are not accepted.
    5. No accommodation will be provided until all payments due have been paid in full. All payments must be cleared and not subject to any chargeback or other dispute in order to be considered as paid.
    6. Where the guest cancels the booking all payments are non refundable.
      In the case of overpayments a credit note can be issued, these will expire after a period of one year from issue.
      It is suggested that guests take out appropriate holiday / cancellation insurance.
    7. If the supplier cancels the booking then payments will be refunded. Such credits will be made back to the original source of the payment.

  3. Personal Details and Privacy
    1. The supplier is required to keep a register of guests over the age of 16 who stay with us, this includes full names and nationality, and/or passport numbers, place of issue, details of next destination if they are non-British, Irish or Commonwealth guests. This is in accordance with the Immigration (Hotel records) Order 1972. These records are kept for a minimum of 12 months and in accordance with the DPA (Data Protection Act 1998) and the GDPR (General Data Protection Regulation).
    2. A CCTV system is in operation. Video from the CCTV system may be shared with relevant authorities such as the police and insurance providers.

  4. Check-in and Check-out
    1. Check-in after 16:00 and before 18:00, local time, on day of arrival.
    2. Check-out by 10:00, local time, on day of departure.
    3. Before check-out any and all extra costs must be settled (e.g. use of EV car charger).
    4. Where travel plans require check in or check out outside these times, this is by prior arrangement only and cannot be after 23:00 (local time), after which guests will need to check in the following day.
    5. Breakfast choices are to be notified by 19:00 (local time), otherwise only a non-cooked breakfast will be provided.

  5. During the Stay
    1. Guests accept that they park their vehicles at their own risk.
    2. Guests accept that they use the electric car charging point on a non-exclusive basis and at their own risk. Usage will be monitored with the Project EV app and there will be a per unit charge for electricity as used from the charger, to be paid prior to check out.
      If there is any problem with the usage recording via the app (such as connectivity issues) then default charges are by vehicle battery capacity, charged per day: up to 40kWh (e.g. Nissan Leaf) £10, up to 70kWh (e.g. Renault Zoe) £15, over 70kWh (e.g. Polestar) £20.
    3. Smoking is not permitted in or immediately around the accommodation, including the decking area.
    4. Barbeques (BBQs), candles, lanterns, tealights or anything else with a flame are not permitted in any area.
    5. Pets are not permitted in the accommodation and are not permitted in the garden or grounds.
    6. All guests agree to respect the privacy and peace of all other staying guests, neighbours and the owners at all times. The supplier reserves the right to cancel a booking with immediate effect if guests are not honouring this agreement or causing a disturbance / nuisance to other guests, neighbours or the owners.
    7. Only the lead guest and the named booking party are allowed to use the property and its facilities, any third party visitors are only allowed access with express permission.
    8. Where WiFi Internet access is provided, guests accept to use this access to the Internet fairly, lawfully and appropriately.
    9. The supplier reserves the right to charge the lead guest for any damages caused through the course of a booking by any member of the booking party. This includes breakages, spillages, stains, damage to furniture or fixtures and fittings. Any accidental damages should be reported as soon as possible in order to minimise damage and associated costs.
      Lost keys will incur a replacement charge, including the cost of replacing lock barrels.

  6. Lost Property
    1. Any lost property will be held for a period of 1 month. No responsibility is accepted in replacing lost items and guests are encouraged to ensure they have all their belongings before checking-out.

  7. Limitation of Liability
    1. The supplier's liability in contract, tort or otherwise arising out of the booking shall not exceed the amount paid by the guest, to a maximum of the full invoice value of the booking, only if all monies due have been paid by the guest.
    2. The supplier shall under no circumstances be liable to the guest for any consequential, indirect or economic loss or damages.
    3. For stays relating to special events it is recommended that specific insurance cover be arranged. The guest accepts any resultant loss for not taking out such cover.

  8. Force Majeure
    1. If either party is subject to an event of Force Majeure, that is circumstances outside its reasonable control, including but not limited to war, fire, industrial disputes or civil commotion, it shall notify the other and the first party's obligations under these Terms shall be suspended until it notifies the other party of the end of such event of Force Majeure.
